General Terms & Conditions of Sale
1. Scope of Application
The following general terms and conditions of sale apply to all contractual relationships and as conditions of use of the water ski facility, aquapark, stand-up paddle and other activities of the company Go Bigger SAS and its equipment, between the company Go Bigger SAS (hereinafter “East Park”) and the contractual partner (the “customer”), insofar as no separate individual agreement has been concluded in writing.
2. General Provisions
Use is at the user’s own risk. Parents are responsible for their children.
By purchasing a card or making a firm reservation, the customer, or the customer acting as an organiser (reservation for third parties (family, friends, employees, partners, etc.), rental of a facility, event), declares that they are aware of, or have been informed of, the risks and dangers incurred on site and during the proper use of the facilities and equipment located there.
The organiser undertakes to inform all participants (each a “user”) of these activities and the content of these T&Cs and to ensure their validity for each user. Explicit information and explanation on the part of the organiser are not required for this purpose.
Each user is required to exercise personal responsibility, caution and a realistic self-assessment. By beginning to use the service, they accept the T&Cs. The user is in particular obliged to comply with the safety provisions and rules and to follow the instructions of the operating staff.
The exact dates and times of bookable offers are published on our website at all times. For operational reasons, a booked offer may be changed at short notice. The person making the reservation is responsible for all payments. Fees must be paid at the time of booking. Places are confirmed upon receipt of payment.
Cards, courses and other offers are non-transferable. Resale is not permitted. Any misuse will be subject to a complaint from East Park. Any loss of a ticket must be reported immediately.
A reduction or extension of the ticket due to a purely temporary operational breakdown, repair or maintenance work, etc. is excluded.
The use of water ski facilities, including all features (ramps, rails, etc.), as well as participation in events, is at the user’s own risk. The user must in particular inform themselves in advance of the typical sports risks associated with such exercises and the use of the facilities, and explicitly accepts these by practising/using them.
The minimum age and mandatory equipment (life jacket, helmet, etc.) depend on each activity and are specified on the East Park website and on site. For water activities, the user must be able to swim.
The consumption of alcohol before all water sports activities is strictly prohibited. Operators under the influence of alcohol may be excluded from activities. Ticketing, course or group fees will not be refunded in such cases.
3. Products and Services
The conditions relating to the products and services presented on the East Park website, the East Park booking site or at the East Park site apply to those products and services.
4. Cancellation Procedure, Cancellation Fees, Right of Cancellation
For information on cancellation deadlines and fees, please consult your account or the corresponding offer on our website. Online reservations can only be cancelled online. The credit is applied to the prepaid account. Reservations made on site may also be cancelled on site.
5. Internal Regulations
The East Park internal regulations apply throughout the East Park site. They are available on the website (https://east-park.fr/regulations/).
6. Activity Cancellation, Modifications
Modifications or reductions due to under-occupancy or over-occupancy or for weather-related reasons are excluded for all types of services. However, the operator may cancel use of the facility if the safe delivery of the agreed service can no longer be guaranteed (weather conditions, unforeseeable defects, etc.).
Cancellations or reductions in the duration of the offer for operational or organisational reasons will be compensated by an extension or a replacement date, if operations allow. If this is not possible, fees will be refunded in proportion to the duration of the cancelled offer.
In the event of (i) misuse of the facilities and operating equipment, (ii) conduct detrimental to operations on the part of the customer or user, (iii) breach of these T&Cs, or (iv) breach of the internal regulations, a reservation, ticket, subscription or other offer subscribed to or purchased by a customer may be terminated without notice and without entitlement to a refund or compensation. Temporary or permanent exclusion from the site is also possible.
7. Other Provisions
The customer is liable to East Park for any damage they have caused. Users are also jointly and severally liable with the customer.
All liability is excluded for valuables and items of equipment, such as customers’ own equipment, which are deposited, stored or kept with the operator. Such depositing, storage or keeping does not give rise to any legal relationship.
Certain parts of our site are under video surveillance.

8. Applicable Law and Jurisdiction
These T&Cs (including all documents referenced in the T&Cs) are, with regard to their validity, interpretation and performance, subject exclusively to French law, to the exclusion of private international law and the Convention on Contracts for the International Sale of Goods (Vienna).
Any disputes to which these T&Cs may give rise, or which may result from or be a consequence of them, and which cannot be settled by mutual agreement, shall be submitted, to the extent permitted by the applicable statutory provisions, to the exclusive jurisdiction of the competent court at the location of East Park’s principal place of business (Bartenheim, France).
